REGULATION ON MUNICIPAL SOLID WASTE CLEANING, SEGREGATION, COLLECTION

REGULATION ON MUNICIPAL SOLID WASTE CLEANING, SEGREGATION, COLLECTION, TRANSPORTATION, RECYCLING, RECOVERING AND DISPOSAL

ONE. RATIONALE.  
1.1. This regulation will be applicable to all households and entities within the city, which is aimed to regulate waste reduction and segregation at source, separate collection and transportation, cleaning of public spaces, waste recycling, recovering and disposing.
1.2. This regulation consist of the Law on Waste and its legislative documents.
1.3. All citizens and entities of Ulaanbaatar city must comply with this regulation.
1.4. Hazardous waste will not be regulated with this regulation.
1.5. Inspector of State inspection agency, Governors, Police agencies, public waste inspectors, law enforcement officials, non-governmental organizations which are authorized by this regulation will be responsible for successful implementation of the regulation.
1.6. All entities who can meet with the minimum requirements of waste cleaning, collection, transportation, segregation, recycling, recovering, and disposing must be registered to the state’s central administrative body in charge of environment and also should be registered to City’s integrated online system of waste management and monitoring. After completing above two, the entity will be able to participate in the selection process and contracting.

TWO. FUNCTIONS OF THE CITIZENS’ REPRESENTATIVE KHURAL AND GOVERNOR OF THE CAPITAL CITY AND DISTRICTS, ULAANBAATAR CITY MAYOR'S OFFICE, AND GOVERNOR OF KHOROOS.  
2.1. Functions of the Capital City Citizens' Khural:
2.1.1. To monitor the implementation of the regulation.
2.2. Functions of the Governor of the Capital City and the Mayor of Ulaanbaatar:
2.2.1. To be responsible and report to the Citizens' Representatives Khural of the Capital City on the implementation of the regulation;
2.2.2. To conclude contract with and grant permits to entities to dispose waste at landfill;
2.2.3. To announce unscheduled public cleanings in the event of force majeure;
2.2.4. To organize activities to increase budget and technical equipment required for waste segregation, collection, transportation, recycling, and disposing at landfill;
2.2.5. To approve methodology for assessing the operational capacity and management of waste cleaning, collection, and transportation entities.
2.3. Functions of the Ulaanbaatar City Mayor’s Office:
2.3.1. To implement the functions of ensuring integrated management, organization, and   professional methodology for, and monitoring and registration of waste cleaning, collection, transportation, segregation, recycling, reuse, recovering, and disposal at landfill in the territory of the Capital city;
2.3.2. To approve the list of streets, roads, and road facilities remote from the city that are considered as public lands to be cleaned with integrated management, regardless of district borders;
2.3.3. Independent supervision over the cleaning, segregation, collection, transportation, recycling, reuse, and disposal of general waste may be carried out by a non-governmental organization, and the supervising non-governmental organization shall be selected and operated in accordance with relevant laws;
2.3.4. To develop the integrated training and promotion methodology on waste in the Capital city;
2.3.5. To conclude “Agreement for waste collection and transportation service in the territories of districts” with District Governors and the waste service provider entities;
2.3.6. To maintain the Integrated electronic system for monitoring and management of waste management in the Capital city;
2.3.7. To monitor the assessment specified in Article 2.2.5 of the regulation on a quarterly basis and issue a conclusion on the reality of the assessment.
2.4. Functions of the District Governors:
2.4.1. To approve the list of streets and spaces considered as public lands within the borders of the district other than those specified in Article 2.3.2 of the regulation;
2.4.2. To assess the operational capacity and management of waste cleaning, collection and transportation entities in accordance with the methodology specified in Article 2.2.5 of the regulation on a quarterly basis and report the results to the Ulaanbaatar City Mayor's Office;
2.4.3. To develop mapping of the district’s streets, roads, spaces, and green areas covered by the public cleaning, to assign them to public and private entities, universities, colleges and secondary schools, and to approve schedules;
2.4.4. To organize regular waste trainings and promotions to the citizens, business entities, and apartment owners' associations in the district at least twice a quarter in accordance with the methodology specified in Article 2.3.4 of the regulation;
2.4.5. To place waste bins that segregates waste into at least two types in public areas and streets of the district in the locations specified in Article 6.7 of the regulation and to reflect the necessary budget in the annual budget;
2.4.6. To ensure the implementation of the regulation in the territory of the district and to take measures to prevent illegal dumping in public areas;
2.4.7. To hold open tenders for “waste collection and transportation services of all households, business entities and organizations in the district”, regardless of the type of ownership in accordance with Article 9.4.2 of the Law on Waste and to conclude contract for waste collection and transportation services;
2.4.8. Waste service entities providing waste collection and transportation services within the territory of the district shall be financed in accordance with Articles 41.9 and 41.10 of the Law on Waste based on the monthly performance assessment referred to in Article 7.4 of the regulation and financing can be deducted, if performance assessment results unsatisfactorily;
2.4.9. To monitor the collection of waste service fees to be paid by business entities, organizations, and individuals according to Article 9.2.2 of the Law on Waste, and also increase the collection of service fees;
2.4.10. In accordance with Articles 9.4.7 and 9.4.14 of the Law on Waste, to employ a public waste inspector responsible for monitoring the implementation of the legislation on waste and to include the required budget in the annual budget for approval;
2.4.11. Recyclable waste collection and temporary storage points should be located within the districts considering specifics of the district;
2.4.12. Budget of the road and public space cleaning should be spent in accordance with the Law on Budget and the tariff budget will be approved by the Capital City Citizens’ Representative Office.
2.5. Functions of the Governors of Khoroos:
2.5.1. To organize waste awareness activities and trainings which should be initiated by the districts, aiming citizens, business entities and organizations of the khoroo;
2.5.2. To monitor schedules of waste collection and transportation;
2.5.3. To support and cooperate with public waste inspectors;
2.5.4. To organize, monitor and keep records of waste segregation of households, business entities, and organizations;
2.5.5. To keep records of the participation of apartment and ger district residents in the public cleaning and make notes in the household ledger.

THREE. FUNCTIONS OF BUSINESS ENTITIES, ORGANIZATIONS, HOME-OWNERS ASSOCIATIONS AND CITIZENS.
3.1. Functions of business entities, organizations, home-owners associations and citizens:
3.1.1. Business entities, organizations and home-owners associations shall regularly clean waste, weed, snow, and ice on public spaces and roads within 50 meters of its surrounding area in accordance with Article 10.2.10 of the Law on Waste;
3.1.2. In case of failure to perform the responsibilities referred to in Article 3.1.1 of the regulation, the district governor should hire a professional organizations and the relevant expenses shall be covered by the responsible business entity, organization, or home-owners association;
3.1.3. Business entities and organizations shall involve their employees in public cleaning and provide necessary tools from its own budget;
3.1.4. Citizens, business entities and organizations shall participate in waste awareness activities and trainings organized by districts and khoroos referred to in Article 2.4.4 of the regulation;
3.1.5. Citizens, business entities and organizations shall segregate their waste at the source in accordance with Article 6.2 of the regulation;
3.1.6. Business entities, organizations and home-owners associations shall have outdoor waste segregation bins by the waste types specified in Article 6.2 of this regulation, which must meet the following requirements:
a. In addition to the general requirements set forth in Article 15 of the Law on Waste, waste bins must have protection, barriers, and lids to prevent from insects, rodents, birds and animals;
b. To have an identification mark and color indicating the type specified in Article 6.3 of the regulation;
c. To have design and appearance that is easy to segregate and store waste;
d. Waste bins must be cleaned regularly and disinfected at least once a month;
3.1.7. Individuals, business entities and organizations shall place all types of waste other than cardboard in special bags which has to be sealed and store them in specific waste bins in accordance with the Article 3.1.6 of this regulation, and load them by waste types to waste trucks according to the waste collection schedule;
3.1.8. When expanding or constructing buildings and structures, location of waste bins shall be reflected in the blueprint. While developing blueprint of the waste bins, it should consider expected waste generation and its segregation types, number of population and business type;
3.1.9. Citizens and business entities and organizations shall have large general and construction waste with a volume of more than 0.75 cubic meters transported by authorized professional organization in accordance with Article 41.3 of the Law on Waste by paying additional service fee;
3.1.10. Business entities, organizations, home-owners associations and households shall conclude a “Contract for waste collection and transportation” with an authorized professional organization and transport waste by segregation types, and the contract shall specify the date, time and frequency of waste collection;
3.1.11. If waste service provider fails to collect and transport waste according to the schedule and types, the Ulaanbaatar City Mayor's Office and the Governor of the district shall take measures to improve the operation of the provider, and if the service provider fails to follow its schedule more than 3 times, contract termination is applicable according to Article 2.4.7 of this regulation and waste transportation service can be done by other provider with adequate capacity;
3.1.12. On public cleaning days, districts will assign areas of public spaces, streets and roads by mapping and after cleaning they should hand them over to relevant organization;
3.1.13. Food markets, supermarkets, and trade centers shall establish points for packing goods purchased by citizens and shall provide them with cardboard boxes;
3.1.14. Business entities and organizations operating in the Capital shall be responsible for collection, reuse, and recycling of the wastes from the following products and their packaging:
a. PET plastic containers;
b. Glass bottles and containers;
c. Vehicle and self-propelled vehicle tires;
d. Aluminum and metal cans and containers;
3.1.15. Alcoholic beverage business entities operating in the Capital shall recall and reuse at least 30% of the bottles from alcohol sold;
3.1.16. Waste generators may implement Articles 3.1.14 and 3.1.15 of the regulation individually or jointly.

FOUR. CLEANING OF PUBLIC SPACES, STREETS AND ROADS OF THE CITY.
4.1. Cleaning of public spaces, streets and roads will be done by an entity or organization that is registered to the City’s integrated online system of waste management and monitoring in accordance with Article 1.6 of this regulation;
4.2. Daily monitoring of road cleaning can be done through non-governmental organizations and the organization will be financed 2% of the total allocated fund of the cleaning;
4.3. Cleaning of public spaces, streets and roads can be done either manually or mechanically depending on the situation or seasonal conditions;
4.4. Waste service provider that are cleaning public spaces, streets and roads must comply with the below mentioned minimum requirements:
4.4.1. Waste service provider must have at least a small scale mechanical cleaner which is specifically designed for cleaning of public spaces, streets and roads;
4.4.2. Working place must have a changing room and bathroom where workers can take a bath. The workplace can be either owned or rented;
4.4.3. Waste service provider must have a vehicle that is equipped with automated brooms and a scatter for salt application. The vehicle must be environmentally friendly, and it must pass the regular inspection of vehicles, which proves that the vehicle’s effect to environment and air quality is within the acceptable limits;
4.4.4. If the above mentioned vehicle is manufactured more that 5 years ago, it should be equipped proper air filter to reduce its effect on air quality;
4.4.5. Waste service provider must have a proper storage to store their salts, which is specifically made for removal of snow and ice;
4.4.6. Waste service provider must be financially capable by paying social insurances and taxes within respective deadlines;
4.4.7. The vehicles that are working in public spaces, street and road cleaning must have Global Positioning System (GPS) installed and it should be connected to the City’s integrated online system of waste management and monitoring;
4.5. Public spaces, streets and roads will include:
4.5.1. International, national, city and local roads and its bridges, underground channels, sidewalks, pedestrians, green areas, fences and dams;
4.5.2. National, city and district-wide parks and carriageways, squares, statues and monuments;
4.5.3. Main and auxiliary roads of apartment and ger areas, road related structures, sidewalks, green areas, playgrounds, parks, squares, parking spaces;
4.5.4. Roads and sidewalks of green areas of the city including camping areas, riverbanks, watercourses and forest areas for hiking;
4.6. Minimum requirements for cleaning of public spaces, streets and roads:
4.6.1. The entities or organizations that are cleaning public spaces, streets and roads that are included in the Article 2.3.2 and Article 2.4.1 should provide orange and blue uniforms respectively to their street sweepers;
4.6.2. Public spaces, streets, main and auxiliary roads of the city must be cleaned everyday whereas roads located outside of the city should be cleaned at least two times per week;
4.6.3. Each street sweepers will be responsible to clean no more than 10,000 m2 area per shift;
4.6.4. Roads, bus stops and parking spaces should be cleaned between 5:00-7:00 a.m. and 6:00-8:00 a.m. in summer and winter respectively;
4.6.5. In case of unforeseen situations like natural hazards the waste service providers are expected to work overtime regardless of working time and shift;
4.6.6. While cleaning roads the street sweepers should place caution sign with safety mirrors at 10 meters ahead of them for their own safety;
4.6.7. While cleaning public spaces and roads, street sweepers should not dispose collected dirt and waste into any sort of drainage systems, wells and flood protection dams nor compile them in an open area which can be carried away by winds, therefore they should have proper temporary storage bins for collected dirt and waste to keep them in place until waste transporter arrives;
4.6.8. Waste bins that are located in public spaces, streets and roads should be emptied regularly, to prevent from overflowing;
4.6.9. While cleaning snow and ice by using salt or other chemicals, the removed snow and ice should not be disposed to green areas and all snow and ice should be properly cleaned within 72 hours after it snows;
4.6.10. Roads, sidewalks, road related fences, waste bins, chairs and other architectural structures that are located in public spaces must be cleaned at least twice per month between April 1 to September 30 and at least once per month between October 1 to March 31;
4.6.11. Moistened cleaning must be done for paved roads and sidewalks between April 1 to September 30 by either manual (by hand) or mechanical moistener;
4.7. Waste service provider that are cleaning public spaces, streets and roads must comply with below:
4.7.1. Employer must provide colored uniform for both winter and summer as well as necessary equipments to street sweepers, drivers, loaders with accordance to Article 4.6.1 of this regulation;
4.7.2. Waste service provider must have approved procedure, schedule and method of cleaning for public spaces;
4.7.3. During winter season street cleaners must apply salt or other related chemicals to roads and sidewalks as soon as it snows to prevent from ice slick and gliding in order to ensure safe traffic;
4.7.4. Waste service provider must be prepared for natural hazards such as heavy snows, dzud and floods. The preparation includes approved emergency plan, number of extra vehicles and equipments by the head of organization and it should be reported to Special Commission of city and district within the first season of a year;
4.7.5. Labor, hygiene and health safety instructions must be introduced to every staff before their shift to ensure their safety and well beings, also uniforms and equipments must be properly checked then their respective tasks will be assigned with employee's signature;
4.7.6. All street sweepers, drivers, loaders and staff must attend proper training of laws, regulations, terms of references, schedules, procedure and method of cleaning, labor, hygiene and health safety instructions and ethics of working environment;
4.7.7. Employer must forbid street sweepers, drivers or loaders to work, if they are feeling unwell, over-tired or used alcoholic beverages;
4.7.8. Cleaned dirt and waste should be compiled, stored in proper bins and then it should be loaded to transportation vehicles;
4.7.9. According to Article 3.1.2 of this regulation waste service provider can clean surrounding 50 meters public space area of any of entity, organization or home-owners association and charge them for the cost of cleaning services which can include waste, weed, ice and snow.

FIVE. ORGANIZING PUBLIC CLEANING ACTIVITIES.
5.1. Below mentioned public spaces, streets, squares and green areas will be included in the public cleaning activities:
5.1.1. 50 meters surrounding area of international, national, local roads and sidewalks;
5.1.2. Railways and up to 50 meters from the railway protection zone;
5.1.3. River courses, riverbanks and its protective zones;
5.1.4. Green areas of campsites;
5.1.5. Roads, sidewalks, green areas, mini-parks, streets, playground, ravines, canals, flood dams and trenches of apartment and ger areas;
5.1.6. Roads, sidewalks, road structures, streets, squares, parks, recreation areas, mini-parks that are not regularly maintained by road and street cleaning;
5.2. Minimum requirements for public cleaning activities:
5.2.1. Collected waste should not be discarded as an open pile nor burned;
5.2.2. Collected waste should be deposited in pre-prepared bags with proper wrapping and should be delivered to designated area for transportation;
5.2.3. Face masks and gloves must be provided to all individuals that are participating in the public cleaning activity to ensure labor, hygiene and health safety;
5.2.4. High school students should participate in the public cleaning activities under supervision from school teacher or/and parents;
5.3. Public cleaning activity can be different depending on the season:
5.3.1. Cleaning, collection and transportation of illegal dumping;
5.3.2. Cleaning of snow, ice and ice slick;
5.3.3. Cleaning of wormwood and weed;
5.3.4. Washing, cleaning, painting and restoration of public spaces, streets, squares, fences and small architectural structures;
5.3.5. Cleaning waste from surrounding areas of roads and railways;
5.3.6. Cleaning waste from entrances, stairs, windows and doors of the apartments;
5.3.7. Cleaning, collection and transportation of waste from streets, ravines and flood protective dams of ger areas;
5.3.8. Cleaning and transportation of waste from campsites, forest areas, riverbanks and river courses.

SIX. SEGREGATION OF MUNICIPAL SOLID WASTE.
6.1. Waste segregation refers to article 4.1.7 of the Law on Waste;
6.2. Municipal solid waste should be segregated at source by following types:
6.2.1. Apartments, entities and organizations that are located in apartment areas should segregate their waste by at least 3 categories mentioned below:
a. Recyclables;
b. Non-recyclables;
c. Food waste;
6.2.2. Ger area households, entities and organizations that are located in ger areas should segregate their waste by at least below 4 categories:
a. Recyclables;
b. Non-recyclables;
c. All types of ashes (Ashes include ash from both improved and raw coals);
d. Food waste;
6.3. Waste types will be assigned below color codes:
a. Plastics and plastic bags — Green;
b. Aluminum cans and metals — Orange;
c. Paper — Blue;
d. Glass — White;
e. Food waste — Brown;
f. Other waste — Black;
g. Hazardous household waste — Yellow;
6.4. Entities, organizations and individuals can expand the minimum segregation types at the source (Article 6.2) to as many as they want while considering available local recycling facilities;
6.5. General rules for metropolitan trade and services will be applied to collection points of recyclables, where recyclables are being sold and stored;
6.6. Collection points of recyclables as stated in the Article 6.3 of this regulation must be environmentally friendly and also must have proper storing area and compressing machines for recyclables;
6.7. Public places and streets that are listed below, which tends to generate higher amount of waste, the size and color of the waste bins should depend on the surrounding area and waste amount:
6.7.1. Market place and mall;
6.7.2. Entertainment area;
6.7.3. Airport;
6.7.4. Railway station;
6.7.5. Bus station;
6.7.6. Taxi stop;
6.7.7. Garden and park;
6.7.8. Recreational area;
6.7.9. Playground.

SEVEN. COLLECTION AND TRANSPORTATION OF MUNICIPAL SOLID WASTE.
7.1. A company that provides waste collection and transportation service of households, entities and organizations of a certain area of district will be selected in accordance with Article 7.5 of tendering or bidding regulation and waste collection and transportation performances of past months;
7.2. “Contract for waste collection and transportation services within the district” will be signed by Ulaanbaatar city Mayor's Office, Governor of the district and waste service provider;
7.3. All parties that signed on “Contract for waste collection and transportation services within the district” have right to terminate the contract (regardless of others will), when any party under performs or fails to deliver contracting terms according to Article 2.3.7 and 2.4.2 of this regulation;
7.4. Non-governmental organization for external monitoring will have responsibility to monitor and evaluate the service providers performance by monthly based on the criteria that are agreed by “Contract for waste collection and transportation services within the district”;
7.5. Waste collection and transportation service provider should at least comply with the below minimum requirements:
7.5.1. Waste service providers for waste collection and transportation of households and entities that are located in the apartment areas must have its own vehicle which is specifically designed for waste collection and transportation;
7.5.2. Waste service providers for waste (including ash) collection and transportation of households and entities that are located in the ger areas must have its own vehicle which has both open load-carrying platform and automated unloading;
7.5.3. Waste service provider must have heated garage with necessary equipments to repair and maintain the vehicles. The heated garage can be owned or rented;
7.5.4. Waste service provider must have at least 2 engineers or technicians with minimum of 3 years of experience in waste management or goods delivery service;
7.5.5. Must be financially capable with no overdue payments to both Social Insurance and Taxation Department;
7.5.6. The vehicles that are collecting and transporting waste must have GPS installed and it should be connected to the City's integrated online system of waste management and monitoring;
7.5.7. The waste collection vehicle must comply with the minimum requirements and also must be environmentally friendly, and it must pass the regular inspection of vehicles, which proves that the vehicle's effect to environment and air quality is within the acceptable limits;
7.5.8. If the above mentioned vehicle is manufactured more that 5 years ago, it should be equipped with proper air filter to reduce its effect on air quality;
7.5.9. At least 1 of the 3 waste transportation vehicles must be equipped with waste compressor for segregated waste or should have open load-carrying platform for ash transportation;
7.5.10. All waste transportation vehicles must have equipped with camera at both front and back side along with sensor which gives signal, if the vehicle gets too close to any objects;
7.6. Waste collection and transportation company should provide below services:
7.6.1. Service provider must have its own website that contains statistic data on waste collection and transportation, revenue from waste fees and its expenditures, waste collection and transportation schedules, routes, human resources, available vehicles, machineries and equipments and awareness raising section for public which contains information on the Law on Waste and legal documents;
7.6.2. Waste loaders and vehicle drivers that are providing waste collection and transportation service must attend at least one training per year, which is focused on waste related laws, communication skills, methods and safety instructions for waste collection and transportation;
7.6.3. Employer must provide waste loaders and vehicle drivers with uniforms for both winter and summer (at least once per year) that meets requirements for safety and health standards;
7.6.4. Employer must forbid loaders and drivers to work, if they are feeling unwell, over-tired or used alcoholic beverages or psychoactive drugs;
7.6.5. Waste service provider must report their waste data including waste collection, transportation by its type, source and amount by according to the approved form and submit it to the Governor of district within deadline;
7.6.6. Waste service provider should allocate at least two percent of its revenue from waste collection and transportation fees to organize awareness raising activities among citizens;
7.6.7. Waste service provider should develop waste collection and transportation plan for emergency situations like natural hazards, by guidance from National Emergency Management Agency (NEMA) and it should be approved by the Governor of district;
7.6.8. Waste service provider must follow National and International standards, norms and requirements;
7.6.9. Waste collection and transportation schedules should be developed for both day and night time, while considering the traffic, road conditions, methods of collecting and loading, waste amount and source, economic efficiency and seasonality;
7.6.10. Waste collection plan (including time and day) should be developed by waste service provider in close collaboration with the Governor of khoroo;
7.6.11. Waste service provider must ensure safety and proper maintenance of the vehicle through insurance, vehicle inspection and creating vehicle file;
7.6.12. Waste service provider must follow National and International standards and requirements, in addition to Article 14 of the Law on Waste;
7.6.13. Waste transportation vehicles must be properly checked before every shift and if its satisfactory, it will be given permission to transport waste, whereas vehicles that are failed, should be not be allowed for service;
7.6.14. If technical and other issue arises waste service provider must have back-up vehicles, equipments, drivers and loaders to prevent from delay in scheduled collection and transportation;
7.6.15. Waste transportation vehicle should not overload its capacity or height and also while transporting it should be properly covered and sealed to prevent from scattering by wind;
7.6.16. When collecting and transporting waste, staff shall follow operational safety guides and prohibit the followings, opening of packing plate lid of the waste compactor truck, leaving the truck unattended, opening the loading section when compacting waste as well as interrupting the pressure valve;
7.6.17. Waste transportation vehicles should be cleaned after transporting waste, also it should be disinfected at least twice per month;
7.6.18. All vehicles must be installed with GPS to monitor waste collection, transportation and its schedules and routes, and GPS should be well maintained to prevent from intentional or unintentional damages;
7.6.19. Waste transportation vehicle with compressor should not be used for any other use with exception of natural hazard situations;
7.6.20. Waste transportation vehicle should not be used:
a. If there is a fluid leakage from vehicle or any damage in its any part including loading and compressing, the vehicle should not be allowed to use;
b. Waste compactor truck is punctured, enclosed body is compromised, angle reinforcement, hook and support are damaged, ability of lift mechanism is compromised, or the compactor is not operational;
7.6.21. Collected waste should be transported to landfill, where it should be weighted, registered and unload waste to a designated site with an approval from responsible officer. Safety instructions should be followed while unloading;
7.6.22. While transporting waste, person on the carrying platform is prohibited;
7.6.23. To prevent from intentional increase in the amount of waste transported to the landfill site, waste transportation vehicle driver should follow instructions from landfill officer on how to be weighed on weighing bridge, also the vehicle should not be equipped with unnecessary additions in order to increase weight of the vehicle;
7.6.24. Waste collection  and transportation company should provide printed and electronic schedules to households and entities;
7.6.25. Waste service provider should introduce new technologies and innovations in waste collection and transportation services;
7.7. Waste collection and transportation service provider within the Capital city must comply with the following minimum requirements:
7.7.1. Recyclables from apartment area households and entities must be collected and transported at least once per week and non-recyclables and food waste should be collected and transported at least 3 times per week, whereas waste from ger areas should be collected and transported at least twice per month regardless of its type;
7.7.2. While collecting waste from households and entities the waste service provider must choose time and labor efficient methods and technologies, which is also safe for loaders and drivers. It is compulsory to use separate bags and bins for segregated wastes;
7.7.3. Signals and speakers are prohibited from 9 a.m. to 6 p.m. in school, kindergarten and hospital areas;
7.7.4. Waste bins that are located in the apartments, entities, public spaces, streets can be installed with waste volume sensors and they should be emptied regularly (before it gets filled 90% of its capacity);
7.7.5. Segregated wastes should be collected and transported separately to avoid mixing;
7.7.6. While collecting waste, fire should be prohibited within 10 meters to prevent from accidental fire;
7.7.7. There should not be more than 2 hours of delay in scheduled waste collection and transportation from households and entities;
7.7.8. While collecting waste, loaders should avoid tearing plastic bags that are wrapping wastes to prevent from scattering;
7.7.9. Waste collectors should clean waste bins and surrounding area after emptying it and they are expected to inform owner of the bin;
7.7.10. Owner of the waste bins are expected to disinfect their bins at least once per month during warm seasons and once in two months in cold seasons;
7.7.11. Waste collection and transportation from public spaces, streets, apartments and entities can happen during night with adequate lighting and also loaders and drivers must follow safety instructions of labor and traffic;
7.7.12. While collecting and transporting waste during night, loaders and drivers should not disturb residents by creating noise or using signal;
7.7.13. Vehicle that is used for waste collection and transportation must be in acceptable condition by passing vehicle inspection and also, waste service provider must cover driver's liability insurance and vehicle insurance;
7.7.14. Waste transportation driver must have at least 3 years of experience in driving vehicles of same categories;
7.7.15. If waste collection and transportation schedule should change, waste service provider is expected to inform residents, entities and organizations in 72 hours advance;
7.7.16. Waste collection and transportation vehicle must have visible logo of the company, license plate and name of the operating district;
7.8. Volume based fee should be applied to the entities and organizations according to the Article 8.7.1 of section 8 of Law on Waste;
7.9. Waste cleaning, collection and transportation company should have contract with waste treatment facilities such as recycling, recovering or disposing depending on the waste type they are collecting.

EIGHT. RECYCLING AND RECOVERING PROCESS OF MUNICIPAL SOLID WASTE.
8.1. Municipal Solid Waste (MSW) recycling and recovering should be done through legal body who is registered according to the Article 8.1.9.b of Law on Waste, obtained its permission by Article 9.3.2 of the law and also it should be registered to City's integrated online system of waste management and monitoring as stated in Article 1.6 of this regulation;
8.2. MSW recycling and recovering companies must report their waste data to Ulaanbaatar city Mayor's Office within deadline as stated in Article 8.1.3 of Law on Waste;
8.3. Environmental impact assessment should be done to MSW recycling or recovering companies according to section 7 of Law on Environmental Conservation;
8.4. MSW recycling and recovering companies must comply with Article 8.1.8 of section 8 of Law on Waste;
8.5. Waste recycling and recovering companies can collect their recyclables through either contracting with waste collection and transportation service provider or Governor of districts as stated in Article 2.4.7 of this regulation;
8.6. Additional requirements of MSW recycling and recovering companies:
8.6.1. Waste recycling and recovering technologies should be internationally accepted with no impact on human health and environment;
8.6.2. End product of recycled waste should comply with National and International standards and requirements, and also it should have no impact on environment, human health, flora and fauna;
8.6.3. Waste recycling and recovering companies must organize trainings among employees on Law on Waste, its related documents, standards, requirements, labor and health safety instructions, recovery methods and technologies;
8.6.4. Develop a guideline on safety use of equipments, machineries, and its maintenance;
8.6.5. Natural hazard assessment must be done on waste recycling and recovering companies then management plan should be developed based on the assessment, which should be approved by emergency agency of the district;
8.6.6. Processing scheme of the recycling and recovering should be drawn and it should be available to the public;
8.6.7. Recyclable or recoverable waste receiving area should have paved surface, and also adequate fences and roof is required to prevent from scattering by wind and it should have equipment or machineries to determine waste composition, to measure waste amount, to load and unload waste, to compress the recyclables;
8.6.8. Waste inputs for recycling must meet with the hygiene standards and also it should be tested and approved by certified laboratories;
8.6.9. Waste recycling and recovering facility should pilot their technology for at least 30 days to set their operational and technical systems, in parallel to this greenhouse gas emissions will be estimated and if it is within acceptable range the facility will be allowed for further operation;
8.7. MSW to energy recovery facilities can be built within city and settlement areas and also small-scale waste to energy facility can be practiced in remote areas to generate energy for heating and water heating purpose, where it is challenging to deliver waste to landfill sites. But this facility should be environmentally friendly and approved by relevant environmental conservation agency;
8.8. The incinerator's operation should be stopped, if the amount of waste overwhelms the incinerator's capacity, if the structure of the incinerator is compromised and if the incinerator's operational limit is surpassed. The incinerator can operate again once all the measures are taken to ensure safe and regular operation;
8.9. Support on land use and infrastructure shall be given to business enterprises which are planning to implement projects to recycle and reuse waste products in accordance with the Law on Land Management and other relevant laws;
8.10. When procuring good and services, the government and state enterprise business entities should prefer and purchase goods that are made of recycled waste.

NINE. TREATMENT AND DISPOSAL OF MUNICIPAL SOLID WASTE.
9.1. Daily independent supervision of MSW treatment and disposal at landfill activities may be carried out by non-governmental organizations and the procuring entity shall select the non-governmental supervising organization in accordance with relevant legislations;
9.2. Independent supervision activities shall be financed at the rate 2% of the cost of treatment and disposal.
9.3. MSW disposal site shall be planned as follows:
9.3.1. When planning a centralized waste disposal site, landfill technology must be chosen based on the waste baseline study, where waste composition, density and amount should be considered;
9.3.2. Waste treatment and disposal facility can be built by state and local funds or international loans and donations but it shall be owned by the Ulaanbaatar City Mayor's Office and environmental assessment and regular monitoring should be conducted for ten years after its closure of category 1 or 2 centralized waste disposal sites;
9.3.3. Articles 17.1, 17.4 and 17.5 of the Law on Waste should be considered when planning waste disposal sites (it must be a category 1 or 2) in 6 districts of Ulaanbaatar city and also protection area should be established;
9.3.4. Article 17.6 of the Law on Waste should be considered when planning waste disposal sites in remote districts (category 3 centralized waste disposal sites);
9.3.5. Participation of local residents should be ensured while selecting and planning the location of centralized waste disposal sites;
9.3.6. In case of planning centralized waste disposal sites of category 1 or 2, soil and groundwater testing should be done and samples shall be collected by drilling at the highest and lowest point of the planned area;
9.4. The followings should be considered when planning and designing the blueprints of category 1 or 2 centralized waste disposal sites:
9.4.1. Whether the selected area has a capacity to store wastes for more than ten years;
9.4.2. Availability of nearby soil to cover waste;
9.4.3. The area should be legally accessible including its required protection area;
9.4.4. Wind direction of the area;
9.4.5. Availability of infrastructure, road network, and communication;
9.4.6. Other factors and risks;
9.5. The followings should be considered when planning the centralized landfill sites:
9.5.1. To reserve the topsoil and use it for green areas and rehabilitation of the centralized site;
9.5.2. To transplant trees and shrubs;
9.5.3. The land should be prepared by digging a hole and extracted soil can be reserved and used for covering the waste or flood protection purposes;
9.5.4. When preparing the base, it should not be sloppier than 2 degrees and it should be able designed to collect water;
9.5.5. Landfilling technology for covering the waste should be selected in consideration with waste amount and composition its chemical and physical properties and annual precipitation;
9.5.6. In case membrane substrate is not required in the landfill area, the base shall be prepared by compacting the clay soil to a permeability of no less than 1x10-6 cm per sec, but if membrane substrate is necessary, flexible HDPE material with a thickness of no less than 2 mm and with capacity to endure (+40 to -40C degrees) shall be selected;
9.6. In case of construction of a centralized waste disposal site in remote districts of the Capital city with private investment, permission must be obtained from the Governor of the Capital and a contract shall be concluded;
9.7. Entities engaged in treatment and disposal of MSW shall carry out the following activities:
9.7.1. The operator of MSW treatment and disposal shall give labor safety instructions to its employees on a daily basis before work starts and shall inspect the occupational safety clothing and equipment;
9.7.2. To provide employees with winter and summer occupational safety equipment, work clothes and shoes;
9.7.3. To conduct trainings on legislations, regulations, standards and requirements on waste, and waste treatment and disposal among employees;
9.7.4. Open fire, smoking, storing combustion materials or lubricants in the centralized site cell and waste receiving area should be avoided;
9.7.5. Grazing or entry of livestock is prohibited;
9.7.6. To cover the cost of annual health check-up of the employees and also health and accidental insurance;
9.7.7. To have a database with a detailed record of waste received, disposed, and buried at the centralized waste disposal site and it should be available to Ulaanbaatar city Mayor's Office, Ulaanbaatar Emergency Management and Coordination Center, District Governor's offices, and authorized providers of waste collection and transportation service;
9.7.8. Annual planning of waste reception area, landfill area, barrier and rehabilitation area, emergency waste reception area in case of accidents or natural hazards, and soil preparation and storage area should be done and approved by head of the entity;
9.7.9. The dispatcher of the centralized waste disposal site should have education level higher than secondary education and also should be capable of working on basic software and registration tools;
9.7.10. Recyclable collection should not be allowed in centralized waste disposal sites therefore, recyclable collectors are prohibited to enter;
9.7.11. Centralized waste disposal site should have contract with professional security organization for security services;
9.7.12. To have relevant measures taken against the drivers and loaders of the transportation organizations who violated the bylaws of the centralized waste disposal site or failed to follow the instruction of dispatcher;
9.7.13. Tariff of Article 9.1.4 of Law on Waste should apply, if individuals or entity delivers their waste to centralized waste disposal site, which is aimed to cover the cost of landfilling;
9.8. Requirements of MSW treatment and disposal:
9.8.1. Waste must be received only in a planned and approved areas, and in case of natural  hazards  and unforeseen  situations, waste will be received in emergency area upon consultation with the Ulaanbaatar city Mayor's Office;
9.8.2. To avoid waste sorting and collection activities at the waste receiving area;
9.8.3. Soil covering and compacting should occur every day at centralized waste disposal sites of category 1 and 2, whereas it should be done no less than 3 times per week at category 3 disposal sites and thickness of the soil cover should not be less than 15 cm;
9.8.4. To take measures to prevent damage to the equipment, sewage and gas pipes of the facility when covering and compacting the waste with soil;
9.8.5. Waste receipt and compaction can be done during night in centralized waste disposal site (category 1 and 2), under supervision of dispatcher in well-lit environment to prevent from accidents;
9.8.6. In case of waste disposal by using biological, chemical or physical methods, the State central administrative body in charge of nature and environment must be well informed and the method should be approved by Specialized Inspection Agency then only Ulaanbaatar City Mayor's Office will provide permission to the centralized waste disposal site;
9.8.7. In case of extreme dry, hot, windy and stormy conditions the waste receiving area must be watered to prevent from waste being blown away and also in case of accidental fire, water pool and spraying machinery should be available to use in order to cease fire, and also employees who will be involved must be trained beforehand;
9.8.8. Roads of the disposal site should be well covered and compacted by using soil to ensure unimpeded traffic;
9.8.9. Drivers, assistants and dispatcher at the disposal site should not be allowed to work, when exhausted, sick or consumed alcohol;
9.8.10. Soil for covering purpose must be reserved beforehand, soil that should be enough to cover wastes for at least 2 months must be reserved between April 1 to September 30, whereas at least 4 months of soil reservation is required between October 1 to March 31;
9.8.11. Machinery and equipment of centralized waste disposal site must meet International and National standards;
9.8.12. Repair and maintenance service centers for heavy machinery and equipment shall be established at centralized waste disposal sites which must be equipped for tire change, patching equipment, air filter cleaning, compressors and other necessary equipment;
9.8.13. To install a Global Positioning System (GPS) that can monitor the operation of heavy equipment and vehicles operating at the centralized waste disposal site and also install cameras in the waste collection area, and it should be connect with the City's integrated online system of waste management and monitoring;
9.8.14. Head of the organization should approve the list of necessary equipment and spare parts;
9.8.15. Staff at the centralized waste disposal site should measure and register weight of the waste, its source and type by using weighing bridge at the entrance and if the transported waste happens to be biological, chemical, hazardous, flammable or explosive the staff has right to prohibit the entrance of the truck;
9.8.16. While leaving the centralized waste disposal site after unloading its transported waste the staff should measure the weight of the empty truck and the weight of the waste shall be calculated, registered and certified by the difference from the weight of the loaded truck;
9.8.17. The registration point of the centralized waste disposal site shall have the following equipments:
a. Surveillance cameras with vehicle number plate sensors;
b. Information display showing the weight of the vehicle;
c. Surveillance camera to control composition of waste in the vehicle;
d. Computer with registration software and printer;
e. Automated registering sensor to register all vehicles that are entering the disposal site;
f. Indoor and outdoor surveillance cameras;
g. Digital weighing bridge connected with the registration software;
h. Equipment to disinfect vehicle's tire;
i. Outdoor lighting;
9.8.18. Liquid waste, human corpse, organ, explosive, chemical or hazardous waste is prohibited to be buried at centralized waste disposal site;
9.9. Emissions from the disposal site to air, soil and water shall be monitored once a year and if the emissions are higher than the standards, appropriate action should be taken immediately and then it shall be monitored again. After re-monitoring, if the emissions are above the standards, Ulaanbaatar city Mayor's Office shall temporarily close the centralized site until the emission meets the acceptable level;
9.10. It is prohibited to excavate the covered and rehabilitated area, to take out the waste and spread, and if inevitable, excavation can be carried out with the permission from the Ulaanbaatar city Mayor's Office and reclamation should be carried out;
9.11. Centralized waste disposal sites of category 1 and 2 shall have the following heavy machineries and equipments:
a. Heavy caterpillar bulldozers;
b. Caterpillar excavator;
c. Vehicles for transporting soil and dirt;
d. Water machine with water spray part;
e. Firefighting equipments, clothes and tools;
9.12. Disaster risk impact assessment shall be conducted at the centralized waste disposal site and it shall be approved by the Emergency Management Department of the district, and management plan shall be developed accordingly;
9.13. Waste treatment and disposal at the centralized waste disposal site shall be financed by the amount of the buried waste in accordance with Article 41.11 of the Law on Waste.

TEN. SANCTIONS.
10.1. Individuals, business entities, and organizations violated this regulation shall be held liable in accordance with the Law on Misdemeanor and other legislation;
10.2. Disputes related to the implementation of waste service standards should be resolved by mutual agreement of the parties and shall be resolved by the court in case of failure to reach consensus:
10.3. An official who violates the regulation shall be held liable in accordance with relevant laws and legislations.
